Non-Compliance with Conditions
In situations where the Regulator believes the operator is failing to meet with the requirements of the permit enforcement options are available including:
- Enforcement notice.
- Suspension notice.
- Revocation notice.
The operator may appeal against any revocation notice to the Secretary of State.
If necessary Regulators have been given powers to prosecute Operators contravening requirements or providing misleading information.
Penalties if found guilty include:
- Fines of up to £20,000.
- Imprisonment for up to 5 years.
